Use of websites provided by Exquisite Cotswolds ("Us") by you, ("You") and any service contained within constitutes acceptance of these Terms & Conditions.

Customer Use
You should always check that your contact information is correct before creating a customer account or proceeding to payment.
Product & Service Pricing
Payment is required via credit/debit card or bank transfer; all fees will be taken in pounds sterling.
We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product or service is found, we reserve the right to either cancel your order, contact you to arrange payment of any extra sum due, or refund any overpayment made by you (as applicable).

Event Photography
Should our event photography be included, Exquisite Cotswolds will document the event candidly and take formal portraits as necessary. If the client wishes to have any specific photos taken, they should inform Exquisite Cotswolds before the start of the event.
The client and Exquisite Cotswolds consent to communicating with each other to achieve the best possible result within the understanding of this contract.
The client also agrees to give Exquisite Cotswolds sufficient warning of key events so our photographer can prepare. Please note that not all people like having their photo taken. In such cases, our photographer will use their discretion but cannot be held responsible for a lack of photos of these people.
Exquisite Cotswolds and their photographer retains the copyright to the images. The images may not be modified publicly without consent, and no derivative works may be made from them without Exquisite Cotswold's consent. Sale, publication, or any commercial use of the photographs is prohibited without prior written permission from Exquisite Cotswolds.
If Exquisite Cotswolds is unable to fulfil the obligations of this contract due to fire, casualty, illness or other event, they will have no further liability with respect to this agreement. This limitation on liability will also apply if images are lost through equipment malfunction or otherwise lost or damaged without fault on the part of Exquisite Cotswolds and their photographer.
Exquisite Cotswolds' photographer's style of work is designed to achieve a great set of photos for the client, which all clients enjoy. Therefore, the client and Exquisite Cotswolds agree that punctuality and cooperation are essential to producing outstanding photographic results. In cases where the event does not run on time, Exquisite Cotswolds cannot guarantee to take a normal set of photos, although, in such circumstances, the photographer will do their absolute best to compensate.
The client grants Exquisite Cotswolds irrevocable and unlimited consent to alter the photographs without restriction and to copyright the images. The client hereby releases the photographer from all liability and claims in connection with the images.

The digital images will be accessible on a secure, password-protected website within 14 days of the event.

Debutante-Inspired Afternoon Tea Cancellation Rights and Refunds
To secure the booking, a non-refundable payment of 50% of the total price of our service is required. The remaining 50% is due six weeks before the scheduled date. No refunds can be offered within six weeks of the scheduled event date.

​Content Submission
Where we allow users to submit content to the Social Media Pages, the views expressed by any user on the website are their own and not those of Exquisite Cotswolds.

As a user, you agree not to do any of the following:
Abuse, harass, threaten, stalk, defame, or in any way seek to violate another user's or third party's rights.

Publish or seek to distribute any material or information that is unlawful, harmful, obscene, indecent, libellous, profane, defamatory, racist, or in any other way inappropriate or objectionable.

Encourage illegal activity or activity that violates other users' rights or third parties, whether individuals or organisations.

Supply or post content calculated to deliberately mislead other users or third parties, including content falsely made to appear from or be endorsed by us.

To pose as another user, third party or organisation, or one of our employees to obtain user or third party information.

To transmit or transfer any viruses, trojans, worms, or any other malicious programs or code intended to spy on, gain control over, disrupt, destroy or in any other way impair any computer hardware or software or any other equipment.

Attempt to gain access to our servers or other equipment to disrupt, impair, overload, or otherwise hinder or compromise the safety, security, or privacy of any of the services provided by or relied upon by other users and us.

Make commercial posts or comment spam or attempt to disguise such spam as content.
​
A post promoting pyramid schemes, chain letters, or any other activity that invites users and others to participate in wasting their time and money.

Use any robot, spider, scraper, or other technical means to access the website or content.

Access
We take all reasonable steps to ensure the website is available and functioning fully. However, we do not accept any responsibility for "downtime" or poor performance of our file servers or where the website or any associated service is unavailable for any reason, whether within or outside our direct control.

We endeavour to respond to all customer complaints or queries within five working days.

Events outside our control
We shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if any circumstances beyond our reasonable control cause the delay or failure, including, but not limited to, acts of God, war, civil disorder, or industrial dispute.

All content, databases, graphics, buttons, icons, logos, layouts, and look & feel are Exquisite Cotswolds' copyright unless expressly acknowledged otherwise.

The data mining, extraction, or utilisation of product information from our website is not permitted without our express prior written permission.

Reasonably Foreseeable Losses
We will be liable for any losses incurred by you due to breaches of these Terms & Conditions by us, where such losses were reasonably foreseeable when the contract was made.

Severability
The paragraphs, sub-paragraphs, and clauses of this Agreement shall be read and construed independently. Should any part of this Agreement or paragraphs, sub-paragraphs, or clauses be found invalid, it shall not affect the remaining paragraphs, sub-paragraphs, and clauses.

Waiver
Failure by us to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing.

Entire Terms & Conditions
These Terms & Conditions set out the entire agreement and understanding between you and us. We reserve the right to change these Terms & Conditions at any time, without giving notice.

Jurisdiction
These Terms & Conditions shall be interpreted, construed, and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
